Who are the smartest people in the courtroom?

Sure the judge is smart.

The lawyers.

The clerks.

The court officers – bailiffs, too.

Far and away the smartest is the jury – a group of 12 from all backgrounds and experiences acting as 1.

With all of those years, diversity, and life experiences listening to the evidence, and the lawyers, and the judge’s instructions, the jury is very likely to make the right decision.

Our Founding Fathers were very wise to set up Trial by Jury.

You need excellent insurance coverage

Not only does it protect your assets if you mess up, it also provides you coverage if you get hit by an uninsured driver or underinsured driver – and there are lots of them out there.

I see way too many people with serious injuries get far too little because there was not enough insurance coverage.

You can prevent that by buying adequate UM coverage.

The best part – it’s not that expensive! It’s one of the most important types of coverage you can buy.

Get a second opinion.

Get a second opinion and maybe a new lawyer.

Some people sign up with a lawyer and figure they are stuck.

Not true.

The law recognizes that sometimes things don’t work out in the lawyer-client relationship.

The most important thing is not bruised feelings of a lawyer, but the interests of the client.

You can change lawyers without penalty.

If you have a problem with your lawyer I suggest the following:

First, call your lawyer and lay it on the line.

Second, if your lawyer doesn’t get it, get a second opinion from another lawyer. This will be CONFIDENTIAL.

Third, make a decision to switch or not.

If you switch, see if your new lawyer will agree to pay anything due your old lawyer out of their fee. Most will do so, if your old lawyer is entitled to anything at all.

Do not suffer a bad lawyer or someone who is nice to you when you sign up and then sings a different tune after they get the case.

Staying Centered

I try to write my blogs and any advertising when I’m sitting on a bench in down-town. People watching always helps me stay centered on real people in the hustle and bustle of life. These things should not be written in a library or behind some big lawyer desk. Perspective is important. And, by the way, I have so little interest in advertising these days. I’ll save that topic for another blog.

I’m NOT bashing your insurance agent or mine.

As you can see from my blogs, I’m very critical of the insurance industry.

I don’t appreciate how they treat good, honest people when they need to make a claim for damages.

By the way, I’m also critical of most lawyers, too.

Any way, my criticism is not directed at insurance agents who sell insurance. Most are decent business people trying to protect their customers. Your insurance agent, like mine, is probably doing their best to sell you what you need for insurance coverage.

These people, however, are not involved in claims. They literally have little, to no, say in how the insurance company will treat you and your claim.

It’s not their table. It’s another department literally.

Even then, my criticisms are usually not even targeted at the insurance claims professions who are hired to work on your claim. Again, most are decent folks trying to make a living.

The trouble is that their hands are tied. They have to pay what the big shots tell them to pay; and in many instances, what some computer says a case is worth.

I never accept a computer’s evaluation of human suffering and you should not either.

Ultimately if your case can not be settled, 12 jurors – living and breathing human beings – sit on the jury, not 12 computers – and that’s a very good thing.



It is about winning.

Coming in second place in my business is painfully unacceptable.

There’s too much at stake for my clients.

Injury victims only get 1 bite at the apple.

So, winning is paramount.

Nobody hires me to lose.

Its about winning – by working harder than anyone else, being genuinely passionate about people, and what they are going through, and being prepared.

Some quick advice.

Never talk settlement numbers with an insurance adjuster until you’ve talked with a lawyer.

Most lawyers offer a Free Consultation.

Just pick up the phone and ask for some advice.

HUSH – look who gets to hide in court – the biggest bully: the insurance company.

At trial the plaintiff is the person making a claim, and the defendant is the person who is being blamed for causing the problem. Both will be in the courtroom.

Insurance pays for the defense lawyers and any verdict the jury might award.

Trouble is – hush – nobody is allowed to talk about insurance and how it gets to hide at court.

Some laws just got to be changed.
