Medical malpractice cases often happen in the strangest ways. This case is no exception.

This particular case resulted in a surgeon being sued for negligence and gross negligence after a spinal operation left a patient permanently paralyzed and unable to control some of his muscles. The plaintiff had fallen in 2007 and hurt his neck. Seeking medical help, he went to a local orthopedic surgeon. The doctor determined the man would need surgery on his back.
The procedure was performed to remove a disk from the plaintiff’s spine, which was to be replaced with fixed metal hardware. “While this might sound like a win-win situation on the surface,” Donahue said, “it certainly did not turn out to be the case, because the doctor tore the dura around the patient’s spinal cord during the operation.” The end result for the plaintiff is limited muscle control and permanent, partial paralysis.
