This horrific crash killed two and injured eight. Thanks to a drunk driver, 10 people’s lives will never be the same.
No one saw this fatal accident coming, not until it was too late to take any kind of evasive action. The police report showed that a 39-year-old woman was driving north in a Mazda SUV, when for some unknown reason, it veered out into the oncoming traffic lane. The head-on collision involved the SUV and a Ford Probe.
As a result of that forceful impact, the SUV flipped several times and ejected several of its passengers, who were not wearing seatbelts. Not a smart choice and one that, in this case, turned out to be deadly. Although EMS crews got to the scene quickly, one person was already dead. The other victim was taken to hospital and died there.
Two other passengers in the SUV sustained life-threatening injuries and were also taken to hospital. The six other people involved in this crash ended up having minor to critical injuries. All in all, the accident scene was a mess and there was a lot of unnecessary suffering as a result of what turned out to be a driver who was under the influence. Police reports indicated the driver of the swerving SUV was drunk and was charged with multiple counts of aggravated DUI.
Would the victims in this instance have the right to file a lawsuit? Yes, and two types of lawsuits: wrongful death and personal injury. Would they have a chance of success? Most definitely. Driving drunk is a choice and a crime. There is no two ways about it. If you make the decision to get behind the wheel of a vehicle while drunk and you kill someone, you pay the price.
While the price the driver pays is nowhere near what those who died paid, they do suffer the consequences of their decisions and actions. As for those killed or severely injured, their only choice to obtain compensation is to file a wrongful death lawsuit and/or personal injury lawsuit. If justice is to be done, it needs to start with a lawsuit and the assistance of an experienced New Hampshire personal injury lawyer. Don’t wait to call one if you find yourself in a similar situation.
