Something caused this catastrophic crash that killed two. The police investigation should determine the reason.
In this reported case, a two vehicle head-on collision took the lives of two people, and seriously injured another. It happened when a Ford Mustang, heading west, was plowed into by a Dodge Charger that had crossed the center line. The 22-year-old Mustang driver was taken to hospital and pronounced DOA. The 26-year-old Charger driver also died.
A passenger in the Mustang, an 18-year-old teen, was flown to the nearest hospital and was listed in stable condition on arrival after treatment. Although alcohol did not appear to be a contributing factor, the police were going to probe deeply into what happened to cause the Charger to suddenly cross the center line. The answer to why the Charger crossed the line will provide some measure of closure to the injured victim, but it will not bring back the dead.
Determining the reason for the accident determines the at fault driver; something the victim needs to know to file a personal injury lawsuit to recover compensation for her injuries. The dead man’s family may also wish to contact legal counsel and discuss filing a wrongful death lawsuit.
Often, when it comes to wrongful death lawsuits, there is insurance money on the table; something those left behind will need to move forward with their lives. They have just suffered the severe emotional shock of losing someone they loved; they should not have to also suffer the financial devastation that often happens in cases like this.
Would the 18-year-old victim in this case be able to recover compensation for her life threatening injuries? There is no reason why she should not, given the circumstances of the case. While no two cases are alike, there are some common factors in many: negligence and the fact that the negligence was a proximate cause of the victim’s injuries. The same is applicable when filing a wrongful death lawsuit. The culpable party needs to take responsibility for their actions and one way to accomplish that is to file a civil suit.
